This Privacy Policy explains how we collect, use and store the information we obtain from or about you when you use our services (the “Service”) through our website BASASF.COM (the “Website”).

THIS PRIVACY POLICY IS NOT A CONTRACT AND DOES NOT CREATE ANY LEGAL RIGHTS OR OBLIGATIONS. BY USING THE SERVICE OR THE WEBSITE, YOU ACCEPT THE PRIVACY POLICY AND YOU EXPRESSLY CONSENT TO OUR COLLECTION, STORAGE, USE AND DISCLOSURE OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY.

Information We Collect

Through the Website we collect “Non-Personal Information” and “Personal Information.” Non-Personal Information includes information that cannot be used to personally identify you, such as your IP address, device ID, anonymous usage data, general demographic information we may collect, preferences you submit and preferences that are generated based on the data you submit. Personal Information includes information that can be linked to a specific individual, such as a name, address, phone number, payment information, email address, login information for third party sites and other information which you submit to us through the Website.

Information You Provide Us
In order to create an account and use the Website, you must first confirm that you are at least 21 years of age or older. When you create an account using the Website, we will ask you to provide us the following information: a nickname, email address, phone number, default delivery address, a photo of your government issued ID, and a photo of your medical marijuana card or doctor recommendation. The information on your medical marijuana card or doctor recommendation varies by state, but will contain some or all of the following: your first and last name, birthdate, address, the last four digits of your social security number, a registration number, and the issuance and expiration date of your card or recommendation. When you place an order, we will collect information about the products you reserve, your reservation time, and delivery location. We may also ask you to identify your favorite products and dispensaries, and will provide you the option to rate and review your reservation experience with each dispensary from which you purchase products on a 5-star scale. Any ratings and reviews you submit will be sent to the applicable dispensary and be viewable by their employees.

Information Collected From Your Device
When you use the Website, we will automatically collect your location via the geo-location features on your device, and, if you access the Website from a mobile device, we may also collect your mobile device’s unique device identifier (“UDID”).

We use third parties’ analytic and tracking tools to better understand who is using the Service, how people are using the Service and how to improve the effectiveness of the Service and its content, and to help those parties serve more targeted advertising to you across the Internet or help us serve more targeted advertising to you. Those third party companies may use cookies, pixel tags or other technologies to collect and store anonymous information such as time of visit, pages visited, time spent using the Service, device identifiers, type of operating system used and other website(s) you may have visited. They might combine information they collect from your interaction with the Service with Personal Information they collect from other sources. We do not have access to, nor control over, third parties’ use of cookies or other tracking technologies.

Our Policies Concerning Children
You must be 21 years of age or older in order to create an account on the Website. We do not knowingly collect or use Personal Information from anyone under the age of 21. If we become aware that anyone under the age of 21 has provided us with Personal Information, we will delete that information and the associated account.

HOW WE USE AND SHARE INFORMATION

Personal Information
Personal Information you provide to us is used to help us communicate with you and to provide you with the Service. For example, we use Personal Information to: (i) register and service your BASA account; (ii) solicit feedback and respond to your questions; (iii) provide technical support; and (iv) inform you about product or promotional offers. In order for the dispensary you select to process your order, we will send them your nickname, email address, phone number, reservation time, delivery location, and the specific products and the quantities you ordered. We may also provide the dispensary you select with suggested products for you based upon information that we gather about your shopping history or consumers with similar shopping histories. If purchasing from a product manufacturer’s menu, we will send the product manufacturer your nickname, email address, phone number, reservation time, delivery location, and the specific products and the quantities you ordered. We may also provide the product manufacturer with suggested products for you based upon information that we gather about your shopping history or consumers with similar shopping histories.

Push Notifications
We may send push notifications to your mobile device to communicate with you about our Service. You can choose to disable such notifications via the settings in the Website at your discretion.

Non-Personal Information
We use Non-Personal Information to help us improve the Service and customize the user experience. We also may aggregate Non-Personal Information in order to track trends and analyze use patterns on the Website. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers, product manufacturers and other third parties at our discretion (including aggregated and/or anonymized information about our users and their use of the Service). In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, or in the event of our bankruptcy or insolvency, your Personal Information as well as Non-Personal Information may be among the assets transferred to a third party. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy.

BASA cooperates with government and law enforcement officials to enforce and comply with the law. We may therefore disclose your information as listed above, if we have a good faith belief that it is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce our Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of BASA, its users or the public as required or permitted by law.

Data Retention
We may store information you provide us, or information that is generated or collected automatically, for as long as is necessary to provide the Service to you.

YOUR PREFERENCES

If you’d prefer not to receive to receive product or promotional offers from us via email, you can use the unsubscribe links contained in our email messages. You can also prevent the Website from obtaining your location by disabling location services on your device. However, doing so means you may not be able to use the Website.

DATA SECURITY

BASA and our service providers implement security measures designed to protect your information from unauthorized access, disclosure or accidental loss or destruction of Non-Personal Information and Personal Information. We utilize appropriate physical, technical and managerial safeguards designed to protect the information we collect from or about our users. BASA’s physical infrastructure is hosted and managed within Amazon’s secure data centers located in the United States and utilize the Amazon Web Service (AWS) technology. Amazon continually manages risk and undergoes recurring assessments to ensure compliance with industry standards.

CALIFORNIA RESIDENTS

California residents may choose to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes or choose to opt out of such disclosure. Our policy is not to disclose personal information collected online to a third party for directing marketing without your approval. USERS OUTSIDE OF THE UNITED STATES

The Service and the servers upon which the Service are hosted are located in the United States and are intended only to be used by individuals in the United States. Personal Information you submit using the Service will be transferred to and stored in the United States. By using the Service and submitting Personal Information, you authorize this transfer. For the avoidance of doubt, BASA is not designed for, or targeted to, or in any way offering goods or services to users who are in the European Union.
